General conditions of sale

 All our products are sold within the limits of our available stocks.  The invoice is addressed to the customer with the sent of his order.  The payment is made by check or bank card, altogether with order. Our prices are stipulated in Euro, inclusive of all taxes. For FRENCH OVERSEAS DEPARTMET TOM and FOREIGNER EXCEPT EEC (catalogue prices exclusive of tax), there will be in supplement taxes current on your territory.  - From the middle october to the beginning of may the rosebushes, the shrubs, the long lived, the small fruits. - From the beginning of september to the end of october and from the middle of february to the middle of may for the strawberry plants. - Concerning the FRENCH OVERSEAS DEPARTMENT TOM and FOREIGN EXCEPT EEC, it will not be sent by rosebushes in clod nor of products with ground and no stalks, weeping and pergolae. - In case of unfavourable weather situation (strong heat or strong frost) the sending of the parcel will be delayed. - En cas de conditions atmosphériques défavorables (forte chaleur ou fort gel) l’envoi du colis sera retardé.  Any complaint concerning the delivery must be sent in the week following the reception of the goods to be consideres and accompanied with the corresponding invoice.  All our products benefit of a total guarantee of satisfaction and they will know how to deserve your confidence. We guarantee you the resumption in vegetation of all the plants to the 30th June following the invoice date.Every article signaled in this delay will be replaced in the good period of plantation and at the latest, the next season. This guarantee is limited to the replacement of defective vegetables and does not apply in case of absolute necessity independent of the quality of the product : frost, inundation, drought etc… We reserve the right to demand the defective plants or to come to notice on the spot the not occasion. In case of failure of resumption superior to 50% considering the quality of products, we consider that a loss so important can result only from a deficient plantation, from insufficient care or from incompatible conditions of culture with the needs of plantations. Plants free or sent outside metropolitan France, deliveries made for professionals, for communities ou charged by third parties are not concerned by this guarantee.  The reproduction of protected varieties or the commercial names marked from the ® sign is prohibited except preliminary authorization. The authenticity of the variety is guarantee by the origine label fixed at the rosebush. Any photographic or different illustration , intended for the publicity of these varieties is prohibited except preliminary authorization. These conditions are reproduced on any offer of sale of rosebushes of the above mentioned varieties. |
